Terms of Service

These Terms of Service ("Terms") are an agreement between you and MakeASong ("we", "us", "our"). They govern your use of the website at makeasong.io and the services offered there (the "Service").

By creating an account, buying credits, subscribing to a plan or otherwise using the Service, you confirm that you are at least 18 years old (or the age of majority where you live), that you have read and agree to these Terms, our Privacy Policy, our Refund & Cancellation Policy and our Acceptable Use Policy, and that you may enter into this agreement for yourself or for the organization you represent. If you do not agree, do not use the Service.

MakeASong lets you describe a song in your own words or paste your own lyrics, choose a style, and receive AI-generated, full-length songs that you can play, download and keep in your library. The Service is a digital, intangible product delivered over the internet; songs are delivered in your browser as soon as they finish generating, usually within a few minutes.

Songs are produced by third-party AI music generation models that we operate the Service on. Their availability and output can change, and we may add, rename, replace or retire the models offered in the Service. We will try to give notice of significant disruptions, but we cannot guarantee that a particular model, style or result will remain available.

AI output is unpredictable: two requests with the same prompt can sound very different, vocals may not match lyrics exactly, and a song may not be what you hoped for. That is why every request returns two takes.

You sign in with a Google account. Keep that account secure: you are responsible for everything done through your MakeASong account. Tell us at support@makeasong.io straight away if you think someone else has used it.

One person, one account. Creating several accounts to collect welcome credits, sharing an account to resell access, or using automated tools to sign up is not allowed, and we may limit welcome credits from the same network to stop this.

The Service runs on credits. Each song request costs 12 credits and returns two songs. The cost of a request is shown before you submit it, and future features may cost a different number of credits. Credits are held when you submit a request and are only charged when it finishes; if a request fails, the held credits are returned to your balance automatically.

• Welcome credits: new accounts receive 80 free credits once. They do not expire, but we may withdraw them if they were obtained through duplicate or automated accounts.
• Plan credits: a plan adds its monthly credits at the start of each monthly period (yearly plans add them every month of the year). Plan credits expire at the end of the month they belong to and do not roll over.
• Pack credits: credit packs are one-time purchases. Their credits remain usable for 365 days from the date of purchase, whether or not you also have a plan.
• Order of use: when you have credits from several sources, the credits that expire soonest are used first; welcome credits are used last.

Credits have no cash value, cannot be transferred to another account and can only be used on MakeASong. Expired credits are not refunded.

Who you pay. Purchases are sold and processed by our reseller and merchant of record, Dodo Payments or Waffo Pancake, shown at checkout. They handle the payment, issue your receipt or invoice and calculate and collect any applicable sales tax, VAT or GST, which is added at checkout where required. Their terms of sale also apply to your purchase. We never see or store your full card details.

Recurring billing authorization. When you subscribe to a plan, you expressly authorize us and our merchant of record to charge your payment method the plan price at the start of the subscription and again at the start of each billing period (monthly or yearly, as you chose) until you cancel. Your plan renews automatically unless you cancel before the renewal date.

One-time purchases. Each credit pack is a single charge for the amount shown at checkout; packs never renew.

Price changes. We may change prices for new purchases at any time. If we change the price of a plan you already have, we will tell you by email at least 14 days before it applies, and the new price only takes effect from your next renewal. You can cancel before then.

You can cancel a plan at any time from your account (Manage plan), which opens the secure billing portal of our merchant of record, or by emailing support@makeasong.io from the address on your account. Cancellation stops all future charges. Your plan and its credits for the current period stay active until the end of the period you have paid for, and pack credits keep their own validity.

Because songs are generated and delivered immediately, payments are generally non-refundable once the credits they bought have been used. Our Refund & Cancellation Policy sets out when you can get a refund (including unused packs, first-time plans, duplicate charges and service failures) and how to ask for one. It forms part of these Terms. Nothing in these Terms limits refund or withdrawal rights you have under the law of the country where you live.

If a charge looks wrong, email support@makeasong.io before contacting your bank. We reply within 2 business days and fix confirmed billing errors within 5 business days. If you open a chargeback or payment dispute, we may suspend the account while it is open and remove the credits from the disputed payment.

Your input. You keep any rights you have in the prompts, lyrics, titles and other material you submit ("Input"). You give us a limited licence to store and process your Input, including sending it to our AI model providers, only to run the Service for you. We do not use your Input or your songs to train AI models.

Your songs. As between you and us, you own the songs generated from your Input ("Output"), and we assign to you any rights we may have in them. You may use your songs for any lawful purpose that complies with these Terms and our Acceptable Use Policy. We may use your songs only to provide the Service to you (for example, storing and streaming them) or where you choose to share them.

No guarantees about rights. AI-generated music may not be protected by copyright in every country, and similar songs can be generated for other users. We do not promise that your Output is unique, that it can be registered with a copyright office, collecting society or content-ID system, or that it does not resemble existing works. You are responsible for checking that your use of a song, including any lyrics you provided, does not infringe anyone else's rights and complies with the rules of the platforms where you publish it.

You must follow our Acceptable Use Policy, which forms part of these Terms. In short: no sexual content involving minors, no sexual or pornographic material, no hate, harassment or violent extremism, no imitation of real people's voices or identities, no infringement of copyright or trademarks (including other artists' lyrics), and no attempts to get around our safety filters. You also may not use the Service or its output to build or train a competing AI model, scrape or resell the Service, or interfere with its security or operation.

You can stop using the Service at any time and ask us to delete your account by emailing support@makeasong.io. Cancel any plan first so you are not charged again.

We may suspend or close your account, remove content and refuse further service if you materially breach these Terms or the Acceptable Use Policy, if we reasonably suspect fraud, payment abuse or multiple accounts, or if the law requires it. In those cases unused credits are forfeited and fees already paid are not refunded, except where the law requires otherwise. If we close your account or discontinue the Service for any other reason, we will refund the unused part of any prepaid plan period and any unused, unexpired pack credits.

The Service and all output are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability or that the output will meet your expectations. AI-generated content can be inaccurate, offensive or similar to existing works; you use it at your own risk.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them, for example for liability that cannot be excluded under consumer law.

These Terms are governed by the laws of the country in which the operator of the Service is established, without regard to conflict-of-law rules. If you live in the European Union, the United Kingdom or another country with mandatory consumer protection laws, you keep the protection of those laws and may bring claims in your local courts. Before starting any formal proceedings, please contact us at support@makeasong.io so we can try to resolve the issue informally.

We may update these Terms as the Service changes. The date at the top shows the latest version. For material changes we will notify account holders by email or in the app at least 14 days before they take effect. If you keep using the Service after that, the new Terms apply; if you do not agree, cancel your plan and stop using the Service. If any part of these Terms is unenforceable, the rest remains in effect.
